Welcome to Glow Arts by Giuzel. These Terms of Service ("Terms") govern your use of our website and the purchase of our custom-made giant flowers. By accessing our store or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer over networks.

2. Custom Artistry & Handcrafted Nature

All products sold by Glow Arts by Giuzel are handcrafted.

Variations: Because each flower is custom-made, slight variations in color, texture, and size may occur. These are not considered defects but are characteristics of original artwork.
Accuracy: We strive to display the colors and images of our products as accurately as possible, but we cannot guarantee that your computer monitor's display of any color will be 100% accurate.

3. Order Acceptance & Customization

Consultation: For highly customized orders, production begins only after the final design specifications are confirmed.
Right to Decline: We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.

4. Pricing and Payment

Prices for our products are subject to change without notice.
All prices are in Canadian Dollars (CAD) unless otherwise stated.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

5. Local Pickup & Shipping

Kelowna Pickup: If "Local Pickup" is selected, you are responsible for scheduling a pickup time. Risk of loss passes to you once the item is collected.
Shipping: We are not responsible for delays caused by shipping carriers. Any claims for items damaged during transit must follow the procedures outlined in our Return and Refund Policy.

6. Intellectual Property

All content included on this site, such as text, graphics, logos, images, and the designs of the giant flowers themselves, is the property of Glow Arts by Giuzel and protected by Canadian and international copyright laws. You agree not to reproduce, duplicate, copy, or sell any portion of the Service or product designs without express written permission from us.

7. Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

For any unlawful purpose.
To solicit others to perform or participate in any unlawful acts.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

8. Limitation of Liability

Glow Arts by Giuzel shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your use of any of our products. This includes, but is not limited to, improper installation of giant flowers or damage caused by environmental factors (wind, rain, heat) if the flowers are placed outdoors.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of British Columbia, Canada.

You can review the most current version of the Terms of Service at any time at this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website.
